Terms of use
Order taking on the Site is subject to compliance with the procedure set up on the Site comprising successive steps leading to the validation of the Order.It involves an obligation to pay.
The Customer who places the Order declares to be the natural person who opened the Account associated with the Order.
The Customer can select as many Items as he wishes which will be added to the basket (the" Basket ")The sale of Articles on the Site being exclusively reserved for retail sale and individuals, no Order can be placed by professional sellers, alone or in groups, regardless of the method of marketing their products (places of internet market, shopping malls, intermediaries, physical stores in particular)The Customer recognizes and therefore accepts that the Articles can only be purchased in quantities corresponding to the average needs of a consumer, both with regard to the number of Articles ordered in a single Order and the number of individual Orders respecting the usual amount of an average consumer spent for the same productMAISON CHOU reserves the right to refuse an Order clearly validated by a professional seller.
The Basket summarizes the Items chosen by the Customer as well as the related prices and costs.The Customer may freely modify the Basket before validating his Order.
The validation of the Order by the Customer constitutes confirmation of the acceptance by the Customer of the GTC, the Items purchased, their price as well as the associated costs.
After validation of the payment, MAISON CHOU sends the Customer an order confirmation e-mail.
All Orders are subject to prior acceptance by MAISON CHOU and are not definitively confirmed until the Customer has received an email confirming the shipment of the Item (s).The Customer formally accepts the use of the e-mail for confirmation by MAISON CHOU of the content of his Order.
The Customer may obtain the invoice relating to any Order by sending an e-mail specifying the number of the Order concerned to hello @ herbarium.fr .
If the Customer does not receive any e-mail following his Order, it is up to him to contact MAISON CHOU customer service.
MAISO N CHOU can in no way be held responsible for any entry error or transmission of an entry error not allowing the delivery of the confirmation e-mail and/or Articles.
For any question relating to the follow-up of an Order, the Customer must consult his Account on the Site or contact customer service.
MAISON CHOU reserves the right to withdraw at any time any Article displayed on the Site and to replace or modify any content or information appearing on the latter.Despite MAISON CHOU's best efforts to meet the expectations of its customers, the latter may have to refuse to process an order after having sent the Customer the confirmation email summarizing the Order.
MAISON CHOU cannot be held liable towards the Customer or a third party for the decision to remove an Item from the Site, or for the decision to replace or modify any content or information appearing on this Site, or for the refusal to process an Order after sending the confirmation email summarizing the Order.
The prices of the Items are indicated on the Site in Euros, including value added tax ("VAT"), but excluding:
- shipping costs, the amount of which is specified before validation of the Order on the Site in the"Deliveries and Returns"section;
- customs fees and other taxes, which must be paid by the Customer directly to the carrier
- additional costs related to possible costs of converting a foreign currency, depending on the payment method chosen by the Client
The prices take into account any reductions applicable on the day of the Order.
Any new taxes or contributions, particularly environmental ones, are likely to be reflected in the sale price of the Items.
MAISON CHOU reserves the right to modify the prices of the Items at any time, the Items being invoiced on the basis of the rates in effect at the time of validation of each Order, subject to availability.
The price of the Items invoiced to the Customer is the price indicated in the Order confirmation sent to the Customer by e-mail.
The Articles are payable in cash upon the actual Order.
Payment for Items is made either via Paypal or by credit card (CB, Visa, MasterCard, American Express) via the secure online payment platform Stripe.
The Customer expressly acknowledges that the communication of his bank card number to MAISON CHOU constitutes authorization to debit his Account up to the price of the Items as indicated during the confirmation of the Order.If applicable, a notification of cancellation of the Order for non-payment is sent to the Customer by MAISON CHOU to the e-mail address provided by the Customer when registering on the Site.
The data recorded and kept by MAISON CHOU constitute proof of the Order and of all past sales.The data recorded by Paypal or Stripe constitute proof of any financial transaction between the Customer and MAISON CHOU.
Delivery means the transfer to the Customer of physical possession of the Item (s ) (the “ Delivery ”).
The risk of loss or deterioration of the Item (s) is transferred to the Customer at the time of Delivery.
When validating his Order, the Customer is offered a Delivery option, namely:
- Delivery Home Standard by DHL (with tracking - without signature)
The Delivery costs applicable to the Order are determined according to the place and the delivery method chosen by the Customer at the time of validation of his Order.These Delivery costs are mentioned in the"Deliveries and returns"section of the Site, as it exists at the time of the Order.
The Customer receives, via the e-mail confirming the shipment of his Order, the tracking number assigned to the parcel allowing him to follow the delivery process of his Order.
Delivery is made to the delivery address indicated by the Customer, it being specified that this address must be the residence address of the Customer or of a natural or legal person of his choice.Delivery cannot be made to hotels or PO boxes.It is the Customer's responsibility to provide the exact and complete information necessary for the proper delivery of his Order and for the perfect Delivery (such as, in particular:street number, building, staircase, access codes, names and/or numbers intercom, etc.).
Delivery is deemed to have been made as soon as the Order is made available to the Customer by the carrier.The control system used by the carrier prevails.
If it is impossible to make the Delivery due to an incorrect delivery address, no reshipment can be made and the Customer will be refunded within 14 days of receipt of the Order by MAISON CHOU, via the means of payment used when ordering.
MAISON CHOU delivers the Orders within the deadlines mentioned in the"Deliveries and Returns"section of the Site, as it exists at the time of the Order, and no later than thirty days after the Order has been confirmed.
MAISON CHOU cannot be held responsible for the delay in delivery not being of its own making or justified by a Case of Force Majeure
If the Delivery deadline is exceeded, the Customer may write to contact@maisonchou.com to request the status of the Delivery and to agree on a reasonable additional delivery period.If the Customer has not received his Order by the end of this new reasonable delivery period, he can denounce the sale by writing to contact@maisonchou.com and obtain, within a maximum period of 14 (fourteen) days, the reimbursement of all sums paid at the time of the Order, via the means of payment used during the OrderIf the Order had already been shipped when the sale was terminated, the Customer must return it to MAISON CHOU for a refund.For this, the Customer writes to contact@maisonchou.com upon receipt of his order, specifying his last name, first name, order number to obtain a prepaid return label.Items must be returned in their original packaging, and without any damage.MAISON CHOU cannot be held responsible for any damaging consequences resulting from a delay in delivery.Only reimbursement of the sums paid on the occasion of the Order by MAISON CHOU is possible, to the exclusion of any other form of compensation.
Any non-professional consumer has a right of withdrawal, without having to justify reasons or pay penalties.
The Customer has a period of 14 (fourteen) calendar days from the day after Delivery to indicate that he wishes to make use of his right of withdrawal.Beyond the said period of 14 (fourteen) days, the sale is firm and final and no return is possible.
If this 14-day period expires on a Saturday, Sunday or a public holiday, it is extended until the next working day.For example, if the goods are received on January 10, the withdrawal period runs from January 11 to 24 inclusive.From the 25th, withdrawal is no longer possibleIf the 24th is a Saturday, the deadline runs until Monday 26th
The customer communicates his decision to withdraw by sending an e-mail to the address contact@maisonchou.com, in which the Customer specifies his name, first name, order number and references of the Item (s) he wish to return
The return is the responsibility of the Customer and is done at his risk via the carrier of his choice.
The Customer sends his parcel no later than 14 days following receipt of the prepaid return label.
The return is offered to the customer in the event that the delivered item does not comply with the Order.In this case, the Customer writes to contact@maisonchou.com in order to receive a prepaid return label.
In any event, the Item (s) must be returned intact and in their original packaging.
The refund is made subject to MAISON CHOU being able to recover the Items initially delivered.
Once the returned Items have been checked, MAISON CHOU undertakes to reimburse the Customer as soon as possible and at the latest within 14 (fourteen) calendar days following the date of receipt of the return package, using the same means of payment than that which will have been used for the payment of the Order.
In the absence of compliance by the Customer with the GTC, MAISON CHOU cannot reimburse the Articles concerned.
Refunds are made in EuroAny additional costs linked to possible costs of converting a foreign currency are the responsibility of the Client.
This return and refund procedure is exclusive of any exchange.
Item not in accordance with the Order or with an apparent defect
The presence of an apparent defect on an Item must give rise to a complaint by e-mailAny complaint must explain the defect concernedOtherwise, no complaint is admissible, and no return or exchange is possible.
The Item must be returned, intact and in its original packaging, with the references of the initial Order and a copy of the complaint to MAISON CHOU's head office, after sending an e-mail indicating the apparent defect of the Article referred to above
The cases of apparent defect give rise, depending on the content of the Customer's complaint, either to the establishment of a credit note for the benefit of the Customer, or to the replacement of the Item, or to the outright reimbursement of the Customer within 14 (fourteen) daysIn case of non-compliance with the return procedure, no exchange or refund or credit is possible.
In addition, MAISON CHOU guarantees consumers against lack of conformity (articles L217-4 and following of the Consumer Code) and hidden defects (articles 1641 and following of the Civil Code) for the Items for sale on the Site under the following conditions:
Noncompliance
The customer:
- has a period of 2 (two) years from the issue of the Article to act in lack of conformity of the Article;
- is exempt from providing proof of the existence of the lack of conformity of the goods during the 6 (six) months following the delivery of the Article; and
- may choose between repairing or replacing the Item, subject to the cost conditions provided for in Article L217-9 of the Consumer Code.
- If the repair and replacement of the good is impossible, and in particular if the Item is no longer available in stock at the time when the Customer asserts the non-conformity of the Item, the buyer can return the good and get return the price or keep the property and have part of the price returned.
Hidden defects
The Customer may implement the legal guarantee for hidden defects in the item sold, within the meaning of articles 1641 and following of the Civil Code, in the event that a hidden defect, prior to the sale and inherent in the Item sold , renders this Article unfit for its use or reduces this use so much that the Customer would not have acquired it, or would have given a lower price, if he had known it
The hidden defect must be a defect that, even when used, should not presentThus, the warranty against hidden defects cannot be accepted when the defect is only the result of normal wear and tear of the item or of its prolonged use or when the defect results from improper use of the item.
The legal guarantee against hidden defects allows the Customer, within 2 (two) years from the discovery of the defect, either to keep the Item and request a reduction in the price, or to return the Item and request reimbursement. of the price paid, in accordance with article 1644 of the Civil Code.
